Roma, 28 aprile 2023 (dopo avere appreso l’assoluzione della Cassazione)

C’era da aspettarselo! Che vi credevate? La storia processuale della mafia non si smentisce mai! All’indomani della sentenza di Cassazione che, “per non avere commesso il fatto”, conferma l’assoluzione che ha visto imputati a Palermo, nel processo sulla trattativa Stato-mafia, gli ex ufficiali del Ros, Mario Mori, Antonio Subranni, Giuseppe De Donno ed anche l’ex senatore Marcello Dell’Utri, ripropongo qui la mia ballata Muriu me frati pi non fari nenti che riprende le parole del grande Salvatore Borsellino, fratello di Paolo, dette all’indomani della precedente assoluzione della Corte d’Appello per la quale “la trattativa ci fu” e “non è reato”. Oggi invece la Cassazione li ha assolti “per non avere commesso il fatto” e sono stati anche prescritti i reati che, al contrario, la sentenza d’appello considerava compiuti dalla controparte mafiosa di Bagarella e Cinà.

Io però, nel vergognarmi profondamente e silenziosamente della “giustizia” italiana, nel riproporvi quella stessa ballata scritta in occasione della prima assoluzione della corte d’appello ed esprimendo tutto il mio infinito sdegno per questa ennesima, rituale assoluzione, faccio mie le parole di Salvatore Borsellino riportate proprio ieri, 27 aprile 2023, da Antimafia Duemila. “Assolti ‘per non avere commesso il fatto’, non perché “il fatto non costituisce reato” ma per non avere commesso il fatto, così recita una sentenza della Cassazione che ci riporta ai tempi di Corrado Carnevale, più di trenta anni indietro.
È una sentenza tombale, vengono prescritti anche i reati compiuti dalla controparte mafiosa, viene sancita la definitiva rinuncia dello Stato a fare Giustizia, ad accertare la Verità.
Il nostro Stato non è, e forse non è mai stato, uno Stato di diritto.
Siamo stati degli illusi a credere che lo Stato potesse processare sé stesso perché ‘il fatto’ c’è stato, ci sono state le stragi, c’è stato il furto dell’Agenda Rossa, ci sono stati i depistaggi ma non ci sono i colpevoli o meglio perché i colpevoli ci sono, ma sono dentro alle stesse strutture di questo Stato assassino e depistatore e quindi sono intoccabili.
Non è questo, non può essere questo lo Stato per cui ha sacrificato la vita mio fratello e solo per rispetto al suo sacrificio non posso e non devo aggiungere altro.
Non ho mai creduto alla Giustizia degli uomini, sono laico e non posso quindi confidare neanche nella Giustizia di Dio, non mi resta, nei pochi anni che mi restato da vivere, che la lotta, una lotta disperata, solitaria, senza speranza, per una Verità che continuerà ad essere occultata, vilipesa, negata dagli stessi assassini che mai, mai, potranno giudicare sé stessi”. Così invece Salvatore Borsellino, fratello di Paolo ucciso nella strage di Via D’Amelio proprio perché indagava sulla trattativa Stato-Mafia, aveva commentato le assoluzioni emanate dalla corte d’appello di Dell’Utri, De Donno, Mori e Subranni: “Paolo Borsellino non solo non è morto invano ma ha vissuto degnamente la sua vita, senza manie di protagonismo e perciò lasciando alle future generazioni l’esempio della onestà unita ad una irraggiungibile sapienza giuridica. Questo significa che mio fratello è morto per niente”. Io come cantastorie non posso che far mio e cantare questo stesso pensiero come unico commento alla recente sentenza di assoluzione.
